1 July 1834 Deed  (V1, #575) – This indenture made and entered into this thirty first day of July in the year of Our Lord one thousand eight hundred and thirty four Between John Baptiste Petre of Bathurst in the County of Gloucester and Province of New Brunswick farmer and Mary his wife of the one part and Edoire Petre and Hilaire Petre sons of the said John Baptiste and Mary his wife of the parish County and Province aforesaid of the other part Witnesseth that the said John Baptiste Petre and Mary his wife for and in consideration of the sum of five shillings of current and lawful money of the Province aforesaid to them in hand well and truly paid the receipt whereof is hereby acknowledged and in further consideration of the sum of twenty five pounds each of lawful money as aforesaid payable as conditioned in a certain bond or mortgage bearing even date herewith to be kept and performed on the part and behalf of the said Edoire and Hilaire their heirs and assigns as by reference to the same will fully appear and with which they are fully content satisfied and paid.  They the said John Baptiste Petre and Mary his wife have granted bargained and sold and by these presents do grant bargain and sell convey and confirm unto the said Edoire Petre and Hilaire Petre their heirs and assigns all that certain piece parcel or lot of land and premises situate lying and being on the westerly shore of the Harbour of Bathurst aforesaid known as the homestead lot number sixteen granted to the said John Baptiste Petre containing in front thirty rods and in the whole one hundred and thirty two acres more or less, as by reference to the grant thereof will more fully appear the said lot number sixteen to be equally divided between the said Edoire and Hilaire in the following manner that is to say Edoire to have the south side of said lot number sixteen adjoining the lot number fifteen granted to Antoine Degrace with a front of fifteen rods and extending to the rear and to contain sixty six acres more or less.  Hilaire to have the north side of said lot number sixteen adjoining the lot No. 17 granted to Michael Petre but presently in the possession of Mr. John Fraser with the remaining front of fifteen rods extending also to the rear and containing the remaining sixty six acres be the same more or less together with all and singular the buildings improvements and appurtenances to the above divided lot or parcels of land belonging or in any wise appertaining, To have and to hold the same unto the said Edoire Petre and Hilaire Petre their heirs and assigns for ever to their only and sole use benefit and behoof forever and to and for no other use intent or purpose whatsoever.  And the said John Baptiste Petre and Mary his wife for themselves their heirs and assigns do covenant and agree to and with the said Edoire Petre and Hilaire Petre their heirs and assigns that they the said John Baptiste Petre and Mary his wife are seized of the premises above described as a good and indefeasible estate of inheritance in fee simple and that they will warrant and defend the same unto them the said Edoire Petre and Hilaire Petre their heirs and assigns forever against the lawful claim or claims of any person or persons whatsoever.  In Witness whereof the said John Baptiste Petre and Mary his wife have hereunto set their hands and affixed their seals at Bathurst aforesaid on the day and year first above written.  (p. 607 missing)

 

30 December 1839 (V3, #255) - John Baptist Peter of Bathurst & wife Mary of Bathurst certify that Edward Peter of Bathurst has paid his debt in conjunction with Alexander Peter from 31 July 1834

 

15 March 1843 Probated Will (V4, #22) – In the name of God Amen I John B. Petre of Bathurst in the County of Gloucester and Province of New Brunswick farmer being now of sound mind and understanding and being desirous of making disposition of my worldly substance in order to secure to myself the necessaries of life while myself and my wife shall live that we may have more time for preparation for eternity do make this my last will and testament.  First having made previous disposal of the lot number sixteen the homestead as by the conveyance of the same duly recorded as by page 606 of the first volume of the records of the County of Gloucester will appear nothing remains to be settled but the land which I hold on the second concession of the lots on the west side of the Harbour of Bathurst in the Block Grant with Romain Le Blanc and eight others and such goods chattels and effects as I now am possessed of or shall die possessed of all which I will and bequeath as follows that is to say I will and bequeath the said lot of land containing about sixty acres to my son Hilaire Petre to have and to hold the same unto him his heirs and assigns forever with all and singular the improvements and appurtenances thereon secondly I will and bequeath unto my daughter Suaill one cow to be delivered to her by the said Hilaire Petre on her wedding day or the day of my death which ever shall first happen.  Thirdly I will and bequeath all the rest residue and remainder of my goods chattels and effects of which nature or kind soever unto him the said Hilaire Petre his executors administrators and assigns forever.  In witness whereof I have set my hand and seal to these presents appointing the said Hilaire my sole executor and receiving his assurance that in case of my death before that of my wife Marie his mother he will keep and maintain her in like manner as she hath been acoustomed and suitable to her station in life during her life.  Btis Petre (L/S) Signed sealed published and declared as and for the last will of the testator in our presence and executed by him were in her presence and in the presence of each other by his desire subscribers thereto.  James T. Register of deeds and wills in and for the County of Gloucester personally came and appeared Lucy End one of the subscribing witnesses to the annexed instrument who made oath that she was present and saw J. Baptiste Petre the testator therein named sign seal and deliver the same as his act and deed to and for the uses and purposes therein mentioned and that she this deponent together with James S. Morse subscribed their names thereto as witnesses in the presence of the said Baptiste Petre and of each other.  Henry W. Baldwin County Regr.  Received and registered the fifteenth day of March in the year of our Lord one thousand eight hundred and forty three as number twenty two and on pages twenty four and twenty five of the fourth Volume of the records of the County of Gloucester.  Henry W.
